The Consumer Rights Act 2015 says:

  • you can ask us to repeat or fix a service if it’s not carried out with reasonable care and skill or get some money back if we can’t fix it.
  • if you haven’t agreed a price beforehand, what you’re asked to pay must be reasonable.
  • if you haven’t agreed a time beforehand, it must be carried out within a reasonable time.

9.3 Our guarantee in addition to your legal rights. We offer the following goodwill guarantee which is in addition to your legal rights (as described in clause 9.2) and does not affect them. We may require the person to whom the guarantee is transferred to provide reasonable evidence that they are now the owner of the relevant item or property.

  1. PRICE AND PAYMENT

10.1 Where to find the price for the services. The price of the services (which excludes VAT) will be the price set out in our price list in force at the date of your order (which can be found at www.magnapropertyservices.com unless we have agreed another price in writing. This price list covers emergency work only. All other work is quoted on a per job basis. We use our best efforts to ensure that the prices of our service to you are correct. However please see clause 10.5 for what happens if we discover an error in the price of the service detailed in your order.

10.2 We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we provide our service, we will adjust the rate of VAT that you pay, unless you have already paid for the service in full before the change in the rate of VAT takes effect.

10.4 Materials. Materials are charged separately to our hourly rate. Costs of materials plus mark up.

10.5 What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the services we offer may be incorrectly priced. We will normally check prices before accepting your order so that, where the service’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the service’s correct price at your order date is higher than the price stated in our price list, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and not perform the services.

10.6 When you must pay and how you must pay. You must make an advance payment of 50% of the price of the Services, before we start providing it. We will invoice you for the balance of the price of the services when we have completed them. All invoices are due for payment immediately.

You must then provide us with access without delay to allow the snagging to be finalised and completed. Payment for the remaining 5% balance will be due following completion of the snagging by the us.

10.8 Other payment arrangements. If we have agreed in writing that you are an account customer, then payment is due 30 days after we invoice you.

10.9 We can charge interest if you pay late. If you do not make any payment to us by the due date (see clause 10.6) we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of NatWest Bank Plc from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.
